Terms and conditions of sale
1. Identification
These terms and conditions of sale govern services provided by COVENIS (“Covenis”), SAS (société par actions simplifiée), SIREN 942 542 176, registered office: 35 rue des Écureuils, 34170 Castelnau-le-Lez, France.
2. Scope and service area
Covenis provides audit, design, supply, installation coordination, configuration and maintenance of home automation equipment in homes within its service area (Up to 100 km driving distance from Castelnau-le-Lez (Hérault, Gard, and the areas around Narbonne, Arles and Avignon)). The physical installation of equipment may be carried out by qualified partner installers under Covenis’s coordination; Covenis remains the customer’s sole contact and is answerable to the customer for their work.
3. Quotes and orders
The online configurator provides an indicative estimate, which is not an offer. After discussion and, where relevant, an on-site visit, Covenis issues a free detailed quote valid for 30 days unless stated otherwise. The contract is formed when the customer signs the quote. Any extra work is subject to an amendment accepted by the customer.
4. Prices and payment
Prices are in euros including all taxes for consumers, at the VAT rate in force (a reduced rate may apply depending on the works and the age of the property, subject to the customer’s certificate). A deposit stated in the quote may be required at order; the balance is due on completion unless a schedule is set out in the quote.
5. Performance and lead times
Lead times in the quote are indicative unless expressly guaranteed. The customer must provide access to the property, electrical installation and Internet connection. Covenis may suspend work if safety conditions are not met; any work on the electrical panel must comply with applicable standards (NF C 15-100).
6. Acceptance
Acceptance takes place at the end of the works with a demonstration and documentation handover. Any reservations are recorded in writing.
7. Right of withdrawal
Where the contract is concluded at a distance or off-premises, consumers have 14 days from conclusion to withdraw without giving a reason (Art. L221-18 Consumer Code) by writing to [email protected]. If the customer expressly asks for services to start before the period ends, they must pay a proportionate amount for what has been provided until withdrawal. Goods must be returned in good condition within 14 days. Custom-made goods are not taken back.
8. Legal guarantees
The customer benefits from the legal guarantee of conformity (Art. L217-3 et seq. Consumer Code) and the guarantee against hidden defects (Art. 1641 et seq. Civil Code), regardless of any manufacturer warranty. Damage due to misuse, third-party modification, lightning, or power or network outages is excluded.
9. Liability
Covenis’s liability is limited to direct and foreseeable damage. Home automation does not replace a certified alarm, fire-detection or safety system unless expressly stated in the quote.
10. Personal data
See the privacy policy.
11. Complaints and mediation
Complaints can be sent to [email protected]. We undertake to examine every complaint and reply as quickly as possible.
12. Governing law
These terms are governed by French law. In the event of a dispute, the courts of Montpellier have jurisdiction, subject to mandatory rules: consumers may always bring proceedings, at their choice, before the courts of their place of residence or delivery.
